WITHDRAWAL AND REFUNDS INFORMATION

The Customer has the right to withdraw from the sales contract, without any penalty and without specifying the reason.

In compliance with the Italian Consumer Code, Customers, in their status of “consumers”, have the right to withdraw from the purchase without being liable to any penalty and without specifying the reason, within the terms of 14 calendar days from receipt of the Products purchased.

In the event that multiple Products have been purchased with the same Order and have been delivered separately, the intention to withdraw may be communicated within 14 days from the date of receipt of the last product.

The return of the Products that are the object of withdrawal must be performed, at the Customer’s responsibility and expense, sending the Products directly to Danghyra’s registered office without undue delay and in any event not later than 14 days from the day in which the Customer informed the Seller of his/her decision to withdraw from the contract of sale.

NON-RETURNABLE ITEMS

Right of withdrawal cannot be exercised in the following cases:

• customized or tailor-made products;
• sealed goods which are not suitable for return for hygienic reasons or related to health protection and have been opened after delivery.

CONDITIONS FOR EXERCISING THE RIGHTS OF WITHDRAWAL

In compliance with the Italian Consumer Code, Customers, in their status of “consumers”, have the right to withdraw from the purchase without being liable to any penalty and without specifying the reason, within the terms of 14 calendar days  from receipt of the Products purchased.

The right of withdrawal is subject to the following conditions:

• all the Products for which the Customer exercises right to withdrawal must be intact and in their original packaging, complete in all parts including packaging materials, any seals that may be applied, and any possible accompanying documentation, such as order reference, delivery note and so forth;
• the Products must not have been used, washed, soiled or damaged and must not show signs of use;
• the return is the responsibility of the Customer;
• the Seller is not liable under any circumstances for damage, theft or loss of the returned Products;
• upon arrival of the Product at the return address indicated by the Seller, the Product will be examined to assess any damage or tampering not resulting from transport.

The Customer will lose the right of withdrawal for lack of the essential condition of integrity of the Products (packaging and/or its contents), in cases where the Seller ascertains:

• the lack or damage of the original packaging;
• lack of labels and / or attached documentation;
• the absence of integral elements of the Product (accessories, parts);
• damage to the Product for reasons other than transport.

In the case that the right of withdrawal no longer applies, and even in the case that the Customer violates wholly or in part the provisions concerning withdrawal Danghyra will ask the Customer if he wishes to have the Product back, charging the shipping costs and without refunding of the sale price.

PROCEDURE FOR RETURN

The Customer who decides to withdraw must follow the procedure described below.

The Customer must communicate his will to withdraw to the Seller by sending a written communication (also using the appropriate "Return Form" available on the Site) by registered letter with return receipt to the address Danghyra Boutique, Sestiere Dorsoduro 3220, 30123 Venice (VE) - Italy or by e-mail at contact@danghyra.com.

The Seller will send the Customer an e-mail confirming receipt of the notice of withdrawal; (please note that the Seller is available from Monday to Friday from 10:00 to 17:00 - CET, excluding holidays).

The return of the Products that are the object of withdrawal must be performed, at the Customer’s responsibility and expense, not later than 14 days from the day in which the Customer informed the Seller of his/her decision to withdraw from the contract of sale.

The return of the Product (s) must take place by shipment by the customer or by physical delivery (by appointment agreed with the Seller), directly to the Danghyra Atelier, Via Della Pila 40, 30175 Marghera – Venezia, Italy.

Pursuant to current legislation, the shipping costs for returning the Products including any customs duties (ancillary charges and customs clearance costs) will be charged to the Customer.

The Seller is not liable for damage or theft/loss of goods returned by uninsured shipments.

Upon receipt of the returned Product, the Seller will examine it to assess any damage or tampering not caused by transport.

REFUNDS

The Seller will reimburse the Customer the Price of the returned Product (s) (net of shipping costs) within 14 days of receiving the notice of withdrawal, provided that the Seller has already received the return of the goods or that the provided by the Customer with proof of having already shipped the goods, being able, up to that moment, to withhold the refund.

The seller will use the same payment method used for the purchase of the Product (s) for the re-credit.

It should be noted that the right of withdrawal as regulated here is reserved only for Consumer Customers as defined by the Italian Consumer Code (Italian Legislative Decree 6 September 2005, 206 No.).
