Access and navigation on the site www.danghyra.com (hereinafter "Site") implies acceptance of the provisions indicated in these terms and conditions of use (hereinafter "Terms of use") by the user ("User"). 

Users who do not intend to accept the content of the Terms of Use should stop accessing and browsing the Site.

The Site is managed by the individual company Danghyra di Raceviciute Dangirute, acronym "Danghyra" (hereinafter "Danghyra") which reserves the right, at its sole discretion, at any time and without notice, to modify these Terms of use.

Danghyra's store is hosted on Shopify Inc., which provides the online e-commerce platform that allows users to buy Danghyra’s-branded products.

• INTELLECTUAL PROPERTY RIGHTS

The entire Site is protected by international legislation on copyright, trademarks and intellectual property.

The contents present on the pages of the Site are the exclusive property of Danghyra, which doesn’t grant any license or other right other than to consult the contents on the Site.

The reproduction, representation, distribution, in whole or in part, of the contents of the site through any type of process, as well as the sale, to third parties in are prohibited. 

The violation of these provisions constitutes counterfeiting and exposes the offender to civil and criminal liability.

• TRADEMARKS AND DISTINCTIVE SIGNS

All trademarks and distinctive signs on the Site are the exclusive property of Danghyra, which makes exclusive use of them. No use of these trademarks and distinctive signs present on the Site is permitted and, therefore, any use that is not permitted, unauthorized and/or does not comply with the law is strictly prohibited.

• ACCOUNT 

In the case of creating a personal account on the Site ("Account"), the User undertakes to provide true and accurate personal information during registration and to update it regularly.

The registered Users are invited not to disclose their account access credentials. The registered Users must promptly notify the Seller of any unauthorized use of their account access credentials.

The registered Users are responsible for any activity carried out through their Accounts and may be held liable for any damages of any nature resulting from the improper use of their account access credentials or for any abuse of the services provided by the Site.

Users are solely responsible for the custody and correct use of their personal information, including the credentials that allow access to the Account.

Users are also responsible for any prejudice that may arise against Danghyra or third parties as a result of the incorrect use, loss of theft of the credentials that allow access to the Account.

• DISCLAIMER

Danghyra is not responsible in relation to the Site or services, such as - by way of example but not limited to - any guarantees of continuity and absence of interruptions or operating errors, protection against harmful programs (such as viruses, bugs , malware or similar).

The User agrees to exempt Danghyra for any possible damage, including, by way of example and not limited to, any direct or indirect damage of any kind, loss or expense, in any case following to the use of the Site, the services, the contents of the Site or related to it.

The User agrees to exempt Danghyra for, any malfunction, error, or any cancellation, interruption, defect, delayed operation or delayed transmission, computer virus or malfunction of the line or system..

• CONTENTS

Access, use of the Site, including browsing, the ability to download information on the products and the purchase of the same on the Site, are activities that can be freely conducted by users exclusively for personal use and in no way related to any commercial, entrepreneurial and professional activity. The activities of use and navigation of the Site are carried out by the User in total autonomy and, therefore, the User will be the one and only responsible for the use of the Site and its contents. In case of non-compliant use by the User, Danghyra cannot be held responsible.

The Site may include links to other websites or other internet sources. Danghyra cannot control such external sites and sources. Therefore, Danghyra cannot be held responsible for such external sites or sources and declines any responsibility for the content, advertising messages, services and other materials available on such external sites and sources. Furthermore, the Danghyra cannot be held responsible for any loss or damage, true or presumed, resulting from the use or reliance made on the contents or articles and services available on external sources.

• APPLICABLE LAW AND JURISDICTION

These Terms of Use are governed by Italian law and must be interpreted in accordance with the same. Where a different competent court is not required by law, the Court of Venice (Italy) will have exclusive jurisdiction for all disputes arising from or in any way related to the use of the Site and/or relating to the Terms of Use.
